This week\u2019s policy developments underscore the intense pressures facing higher education and federal oversight, from shutdown-related layoffs to new proposals that challenge institutional autonomy and access for students. At the same time, we are seeing colleges, states, and advocates step up to defend students, protect equity, and preserve academic freedom. Even in the midst of disruption, these actions highlight the resilience of the education community and the impact of organized advocacy in shaping policy outcomes.<\/p>\n<p><b><span data-contrast=\"auto\">Policy &amp; Legislative Updates<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p>The Trump administration\u2019s latest actions have intensified tensions across the education landscape, with colleges, advocates, and policymakers responding to a series of escalating developments affecting students, institutions, and federal oversight.<\/p>\n<p>The administration turned its attention to undocumented student supports, directing the Education Department to investigate the <a href=\"https:\/\/www.insidehighered.com\/news\/government\/politics-elections\/2025\/10\/10\/trump-targets-nevada-renos-undocumented-student\">University of Nevada, Reno\u2019s UndocuPack program<\/a>. The Justice Department claimed the university may have used taxpayer funds to \u201cassist illegal immigrants,\u201d while university president Brian Sandoval, a former Republican governor, strongly defended the initiative as lawful and fully state-funded. Advocates warn that the probe could serve as a \u201ctest case\u201d aimed at deterring other campuses from offering services to undocumented students.<\/p>\n<p>At the same time, the Trump administration introduced a proposed Compact for Academic Excellence in Higher Education, which ties new federal funding opportunities to institutional commitments around admissions, hiring, and \u201cviewpoint diversity.\u201d The proposal <a href=\"https:\/\/www.chronicle.com\/article\/the-white-house-sent-its-compact-to-9-universities-heres-what-their-administrators-and-faculty-are-saying\">drew immediate skepticism from higher education leaders<\/a>, who voiced concerns about threats to academic freedom and institutional independence. Faculty senates and professional organizations have urged colleges to reject the compact outright, calling it an attempt to restrict academic freedom, politicize research, and constrain inquiry. <a href=\"https:\/\/orgchart.mit.edu\/letters\/regarding-compact\">MIT became the first to formally decline<\/a>, stating that federal funding should be merit-based, not politically conditioned. Following MIT\u2019s rejection, the <a href=\"https:\/\/www.insidehighered.com\/news\/government\/2025\/10\/15\/trump-opens-compact-all-higher-ed-now-what\">administration expanded the offer<\/a> to all colleges and universities nationwide, prompting further backlash.<\/p>\n<p><a href=\"https:\/\/www.brown.edu\/sites\/default\/files\/brown-response-federal-compact-10-15-2025.pdf\">Brown University<\/a> soon joined MIT in rejecting the compact, emphasizing the importance of protecting academic integrity and freedom from political interference. The <a href=\"https:\/\/penntoday.upenn.edu\/announcements\/update-penns-response-compact-academic-excellence\">University of Pennsylvania<\/a> also added its voice, announcing that Penn would also decline to sign. Additionally, the <a href=\"https:\/\/we-are.usc.edu\/2025\/10\/16\/update-from-interim-president-kim\/\">University of Southern California<\/a> has declined to sign, indicating that over time the Compact would \u201cundermine the same values of free inquiry and academic excellence that the Compact seeks to promote.\u201d<\/p>\n<p>As higher education leaders push back on these ideological initiatives, the administration\u2019s budgetary and personnel decisions have deepened instability across the federal workforce and at the U.S. Department of Education. <a href=\"https:\/\/www.edweek.org\/policy-politics\/ed-dept-offices-will-be-virtually-wiped-out-in-latest-layoffs\/2025\/10\">Nearly 500 Education Department employees were laid off<\/a>, among an estimated <a href=\"https:\/\/www.npr.org\/2025\/10\/10\/nx-s1-5570933\/shutdown-federal-workers-rifs-layoffs-vought\">4,200 individuals<\/a>, in a new wave of cuts during the ongoing government shutdown \u2014 following an earlier round that had already reduced staff by half. The latest layoffs hit hardest in the Offices of Elementary and Secondary Education, Special Education, and Civil Rights, leaving some divisions with only a handful of staff. Unions and advocacy groups have <a href=\"https:\/\/www.afge.org\/globalassets\/documents\/generalreports\/2025\/shutdown-complaint-093025.pdf\">filed lawsuits<\/a> alleging the reductions are unlawful attempts to dismantle the department. Although the Supreme Court allowed the first round of cuts to proceed, a <a href=\"https:\/\/www.npr.org\/2025\/10\/15\/nx-s1-5574111\/government-shutdown-federal-employees-congress-rif\">federal judge<\/a> recently halted the most recent layoffs, calling them \u201clikely illegal.\u201d<\/p>\n<p>The <a href=\"https:\/\/www.npr.org\/2025\/10\/15\/nx-s1-5575134\/government-shutdown\">government shutdown<\/a> has now stretched into its third week, leaving thousands of federal employees without pay and disrupting core services nationwide. Education programs and enforcement activities have been significantly affected, with the department\u2019s capacity to administer grants, enforce civil rights protections, and support students with disabilities severely diminished. The shutdown\u2019s ripple effects are being felt nationwide: food assistance programs like WIC are nearing exhaustion, federal workers are missing paychecks, and key education, housing, and fair housing offices have been gutted. Meanwhile, essential services like air traffic control and the military continue to operate \u2014 some without pay \u2014 as uncertainty deepens across the country.<\/p>\n<p>Amid the federal uncertainty, several state and institutional efforts are moving in the opposite direction \u2014 advancing access and equity even as national policies sow disruption. California enacted a new law establishing <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb640\">direct admission to Cal State universities<\/a> for eligible high school seniors \u2014 a policy designed to remove barriers and increase college enrollment among underserved students. In another key development, the Hispanic Association of Colleges and Universities (HACU) and LatinoJustice PRLDEF have been <a href=\"https:\/\/www.latinojustice.org\/en\/press\/latinojustice-and-hacu-will-defend-hispanic-serving-institutions-nationwide-federal-lawsuit\">granted permission to intervene<\/a> in a <a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2025\/2025-6-hsi.pdf\">federal lawsuit<\/a> to defend the Hispanic-Serving Institutions (HSI) program, ensuring that the interests of HSIs and their students are represented in court. Their involvement comes as <a href=\"https:\/\/gonzales.house.gov\/_cache\/files\/f\/6\/f6a5e84b-1f10-4d9d-b6d1-b3e6edd29202\/A490840A27A5BA9639BEB01B0F58F807BC51EF819636FF773E453A1FA0EA339C.10.8.25-chc-hsi-funding-letter.pdf\">congressional Republicans<\/a> urge Education Secretary Linda McMahon to restore more than $450 million in funding for HSIs after the department deemed the programs unconstitutional.<\/p>\n<p>Finally, the Education Department has again postponed its <a href=\"https:\/\/sites.ed.gov\/naciqi\/files\/2025\/09\/NACIQI-Rescheduled-Summer-2025-Agenda_508-Compliant_Final-2.pdf\">semiannual NACIQI meeting<\/a>, now scheduled for December 16, following months of shutdown-related disruptions. The delay will postpone critical accreditation reviews and new appointments, raising concerns about an expanding backlog and further uncertainty in federal oversight.<\/p>\n<p><b><span data-contrast=\"auto\">NACAC Advocacy<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p>This week, NACAC joined national coalitions in two major advocacy efforts to safeguard students and uphold sound federal policymaking.<\/p>\n<p>NACAC <a href=\"https:\/\/www.ihep.org\/wp-content\/uploads\/2025\/10\/PSD-ACTS-Sign-on-Letter_10.14.25.pdf\">signed a letter with 35 organizations<\/a> urging the Education Department to pause and revise its proposed Admissions and Consumer Transparency Supplement (ACTS) to IPEDS. The coalition, led by the Postsecondary Data Collaborative, warned that the proposal\u2019s scope, speed, and lack of vetting would compromise data quality and impose excessive reporting burdens on institutions. The letter recommends narrowing the initial rollout to undergraduate data, delaying retrospective and graduate data collection, and reinstating technical assistance and staffing at NCES to preserve the integrity of federal education data.<\/p>\n<p>NACAC also joined a <a href=\"https:\/\/www.ihep.org\/wp-content\/uploads\/2025\/10\/PSD-ACTS-Sign-on-Letter_10.14.25.pdf\">broad alliance of disability, civil rights, and education organizations<\/a> in condemning the Trump administration\u2019s sweeping layoffs at the Education Department. The reductions have severely weakened key offices \u2014 Special Education Programs, Civil Rights, and Elementary and Secondary Education \u2014 undermining enforcement of IDEA, Section 504, and other laws that safeguard the rights of students with disabilities.
